No Prima Facie Case Established in Petitions Against Electoral Commissioner and Special Prosecutor
Presidency Communications has announced that no prima facie case has been established in petitions seeking the removal of the Electoral Commissioner, her Deputies, and the Special Prosecutor.
In a statement dated Wednesday, February 18, 2026, the Presidency disclosed that President John Dramani Mahama had earlier received seven petitions from various individuals and groups calling for the removal of the Chairperson of the Electoral Commission and her Deputies, as well as three separate petitions for the removal of the Special Prosecutor.
In accordance with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), the President referred the petitions to the Chief Justice, Justice Paul Baffoe-Bonnie, on November 25, 2025, to determine whether they disclosed a prima facie case warranting further action.
By a letter dated January 26, 2026, the Chief Justice informed the President that the petitions failed to establish a prima facie case to justify any further investigations into the removal of the Electoral Commissioner, her Deputies, or the Special Prosecutor.
