The Ashaiman District Court has remanded a 43-year-old soldier, WOII Dzisenu Ben, into police custody over the alleged killing of 45-year-old Abdul Shaban at Mawugbedzibe near Afienya.
WOII Dzisenu, who is charged with murder contrary to Section 46 of the Criminal Offences Act, 1960 (Act 29), did not have his plea taken.
The court, presided over by Derick Parden Eshun, remanded him to reappear on August 27, 2026.
Inspector Henry Tetteh Nartey, prosecuting, told the court that on August 23, 2025, WOII Dzisenu and WOI Yamoah Mark, both of the Base Ammunition Depot (BAD), Michel Camp, went to the Afienya Police Station to report an incident at Mawugbedzibe.
The prosecution said the two reported that while on their landed property at Mawugbedzibe, an unknown man attacked WOII Dzisenu and attempted to disarm him of his M16 rifle, prompting the soldier to shoot him.
Police subsequently accompanied the two men to the scene, where they found Shaban’s lifeless body lying on the ground.
The prosecution said the deceased had a suspected gunshot wound to the upper chest, close to the neck.
His body was conveyed to the Tema General Hospital mortuary for preservation and autopsy after he was pronounced dead.
According to the prosecution, the rifle, identified as No. 000470-11, together with its magazine and ammunition, was retrieved and retained for investigation.
A post-mortem examination conducted by Dr Eric Dumfeh, pathologist at the Tema General Hospital, found that the cause of death was a perforating gunshot wound to the heart.
The prosecution said a bullet retrieved from the deceased’s body was subsequently submitted to the Police Forensic Laboratory for ballistic examination.
It said the pathologist’s report indicated that the features of the wound were consistent with a near-contact, angled gunshot wound and suggested that the shooter was at a higher level than the victim.
The court heard that both the accused and WOI Yamoah Mark later submitted written investigation caution statements in the presence of an independent witness.
Inspector Nartey said the case docket was subsequently duplicated and forwarded to the Attorney-General’s Office for advice.
Following the Attorney-General’s advice, the police formally charged WOII Dzisenu with murder and arraigned him before the Ashaiman District Court.
The court subsequently remanded WOII Dzisenu into police custody to reappear on August 27, 2026.
