Rev. Sam Manful Speaks Out: Litigation Has More Cons Than Pros

Global Ark of Grace Chapel’s Head Pastor, Rev. Sam Manful, has made a thought-provoking statement about litigation, emphasising that it has more cons than pros.

Speaking on Nyansapɔ Fie show with Ohene Kinnah, Rev. Manful highlighted the importance of considering alternative dispute resolution methods.

The Cons of Litigation:

– Lengthy and Costly Process: Litigation can take years to resolve, resulting in significant financial burdens and emotional stress.

– Damage to Relationships: The adversarial nature of litigation can irreparably harm professional and personal relationships.

– Public Exposure: Court proceedings are often public, which can lead to unwanted publicity and reputational damage.

– Limited Control: Once a case goes to court, the parties involved have limited control over the proceedings and outcome.

The Pros of Litigation:

– Clear Resolution: Litigation provides a final judgment or order, offering clarity and certainty for all parties involved.

– Enforceable Decisions: Court judgments are legally binding and enforceable, ensuring that parties comply with the outcome.

– Legal Precedents: Litigation can set legal precedents, providing guidance for future cases with similar issues.

God’s Perspective on Litigation

Rev. Manful also shared his insights on God’s perspective on litigation, stating that while God can be seen as litigious, it’s primarily to defend His people, showcasing His just nature.

According to Rev. Manful, God’s actions demonstrate a desire to protect and vindicate those who are His, rather than engaging in disputes for personal gain.

Expert Insights

Mary Bright Abelenma Coffie, an ADR Practitioner, fashion designer, and youth counsellor, offered additional perspectives on litigation.

She noted that everyone has a bit of a litigious trait in them, but emphasised the importance of parents exercising calmness to avoid inculcating litigious tendencies in their children.

Coffie attributed the reasons for people being litigious to past experiences and a lack of faith, suggesting that these factors can contribute to a more adversarial approach to conflict resolution.

Rev. Manful’s comments, combined with Coffie’s insights, serve as a reminder to carefully weigh the pros and cons of litigation before pursuing legal action. By considering alternative dispute resolution methods, individuals and organisations can potentially avoid the drawbacks of litigation and find more efficient and effective solutions to their disputes.
