Yellow Ghana leader files injunction to halt EC from printing poll materials

Leader of the Yellow Ghana movement, Samuel Apea-Danquah, has filed for an interlocutory injunction seeking to restrain the Electoral Commission (EC) from printing the notice of poll and ballot papers ahead of the December 7 general elections.

Lawyer for Mr. Apea-Danquah, Martin Kpebu in his application, is praying the court to declare that the decision of the EC as contained in a letter dated September 20, 2024, disqualifying the Applicant from contesting the 2024 Public Presidential Elections, without indicating any specific ground for his disqualification, and without offering the Applicant the opportunity to be heard, constitutes a blatant breach of the Applicant’s fundamental right to a hearing.

Apea-Danquah was disqualified along with Bernard Mornah of the People’s National Convention (PNC) and Janet Nabla of the People’s National Party (PNP) and eight other candidates.

The applicant is also seeking a declaration that the purported disqualification of the 1st Applicant from contesting the 2024 Public Presidential Elections is illegal as same contravenes Articles 12(1) and (2). 21(3), 23, 34(1), 35(4), 37(2)(b), 37(4), 40(c) and (d), 41(b) and (d). and 55(3) and (10) of the 1992 Constitution, and Regulation 9 of the Public Elections Regulations, 2020 (C.I.127).

The disqualified Apea-Danquah has consistently maintained that the EC’s decision was based on lies.
