NDC Calls For Amendment To Article 88(5) Amidst Criticism of Government’s Handling Of Corruption Cases

Mrs Comfort Aniagyei, CEO of FreeMinds Communication Limited, has proposed an amendment to Article 88(5) of the 1992 Constitution, a move that has garnered support from Ike Lord, a member of the NDC’s communication team for Kpone Katamanso Constituency.

On Plan B FM’s Nkɔsoɔnsɛm programme, hosted by Obidehyeɛ Kofi Sekyi, Lord argued that the amendment would empower civil society organisations, individuals and groups to pursue legal action with robust evidence, rather than relying solely on the Attorney General.

“The current provision prevents many individuals with solid evidence from accessing justice, thereby perpetuating corruption,” Lord contended. “Amendment would eliminate the noli prosequi clause, which allows the government to discontinue prosecution at its discretion.”

In a separate development, Francis Kwasi Badu Mello, another NDC communication team member for the same constituency, criticised Samuel Atta Akyea’s defence of Kwabena Adu-Boahen. Mello questioned the rationale behind using national security as a justification for alleged misappropriation of funds.

“Why would you use national security as a bargaining chip in a case of financial impropriety?” Mello queried, pointing out that Atta Akyea’s stance was particularly puzzling given his extensive experience in politics and familiarity with the law.
