It Is Difficult To Determine Outcome Of NDCs Petition – Lawyer John Darko

Lawyer John Darko, a constitutional Lawyer and a Lecturer at GIMPA has said that it would be difficult for one to determine the outcome of the National Democratic Congress (NDC) petition before the supreme curt.

The National Democratic Congress (NDC) flagbearer, John Mahama, has filed a petition at the Supreme Court to challenge the outcome of the December 7, 2020, presidential elections.

The lawsuit follows weeks of street protests over alleged voter fraud and irregularities in the just-ended polls. The suit was filed on, Wednesday, December 30, 2020, by Mr. Mahama’s lawyers following the party‘s audit of the 2020 Presidential results “and extensive consultations with the National Executive Committee and Council of Elders of the party”.

The Electoral Commission (EC) after the December polls declared President Akufo-Addo, winner of the polls adding that the NPP led by Akufo-Addo polled 6,730,587, representing 51.6% of the ballot. Mahama according the EC polled 6,213,182 representing 47.4%   John Dramani Mahama, the National Democratic Congress’s candidate, got 47.4% of the vote. Mahama has described the result as “illegal” because the proper voter verification process wasn’t followed.

“The petition details serious violations of the 1992 Constitution by the Electoral Commission,” the NDC said in a statement on Wednesday. “It seeks among others, a declaration from the Supreme Court to the effect that the purported declaration of the results of the 2020 presidential election on Dec. 9 is unconstitutional, null and void.”

The challenge against the outcome of the presidential vote is the second to be filed in the Supreme Court. Akufo-Addo, the then-opposition leader filed a petition to contest the Dec. 7, 2012 elections, which he lost to Mahama.

But speaking to Plan B FM, a Tema-based radio station, Lawyer Darko stated that it is difficult to determine the outcome of the petition. According to him

According to him, cases before law court are usually not discussed especially persons like him.

He said, this case is dynamic and its before the Supreme court with competent Judges expected to preside over and so it would be difficult for anyone to determine the outcome.
