John Ato Breboh, Deputy Chief Investigator at the Tema Sub-Regional Office of the Commission on Human Rights and Administrative Justice (CHRAJ), has stated that individuals are entitled to defy rules that contradict the 1992 Constitution of Ghana.
Speaking on Plan B FM’s social and lifestyle programme, “Nyansapɔ Fie”, hosted by Nana Asabea, Breboh defined defiance as a bold and intentional refusal to obey or comply with procedures laid down by an establishment that may be contrary to the Constitution. According to Article 2(1) of the Constitution, Breboh emphasised that it is constitutionally justified to resist any rules or laws that are inconsistent with the Constitution. He further noted that even laws passed by Parliament and assented to by the President can be declared null and void by the Supreme Court if they contravene the Constitution.
”You are entitled to defy any rules that oppress the people as rules are made to help guide and guard the people and not suppress them”, he said
