In a striking commentary that has sparked debate across the political landscape, Dr. Arthur Kennedy, a notable member of Ghana’s ruling New Patriotic Party (NPP), has raised alarms about the perceived political bias of the nation’s Supreme Court. His remarks, made during the October 19, 2024, edition of Joynewsfile, suggest a troubling trend in judicial conduct that could undermine public trust in the country’s legal framework.
“On too many occasions, like the Domelevo case, the LGBT case, and in this current case, our Supreme Court appears now to be doing more politics than law,” he stated.
His comments come in light of a recent Supreme Court ruling that granted a stay of execution against the Speaker of Parliament’s declaration of four parliamentary seats as vacant. This decision was made just a day after Speaker Alban Bagbin had declared the seats vacant based on constitutional provisions, raising questions about the timing and motivations behind the Court’s actions.
Kennedy pointed to the stark contrast in the handling of various cases, noting that while Domelevo’s case faced significant delays, the LGBT legislation received expedited attention. “It is strange, for example, that Domelevo’s case took as long as it did,” he remarked, questioning why recent decisions have been made with such rapidity.
According to Ghanaweb, Dr. Kennedy expressed concern that if this trend continues, it could create a dangerous precedent in Ghana’s political landscape. “I fear that sooner or later, we are going to get into the realm where every new government will insist on having its own Supreme Court and its own Electoral Commission,” he warned.
