Special Prosecutor causes reversal discounts on FoB value of goods, home delivery

The Office of the Special Prosecutor (OSP) has reversed the discretionary discount on Free on Board (FOB) value of goods and the Home Delivery Value (HDV) of vehicles.

The reversal takes effect from January 1, 2023.

“The OSP notes, with gratification, that following its various investigations and interventions, the Government has reversed the discretionary discount on Free on Board value of goods and Home Delivery Value (HDV) of vehicles,” a statement dated 29 December, 2022 indicated.

According to the OSP, this decision effectively shuts all avenues for officers of the Customs Division of the Ghana Revenue Authority to grant discretionary markdowns and removes opportunity for corruption and corruption-related activities.

The press release, which was signed by the Special Prosecutor, Mr. Kissi Agyebeng, added that, “the various investigations commenced by the OSP at the Customs Division would proceed and the Office will monitor the implementation of the new policy.”

It would be recalled that the OSP on August 3, 2022, launched a full investigation into all rulings and benchmark values applied by the Customs Division of the Ghana Revenue Authority (GRA) dating back to 2017.

The Special Prosecutor directed the then Commissioner of Customs, Col Kwadwo Damoah (Rtd) to submit all documents pertaining to transactions between July 2017 and December 2021.

This comes after developments that followed the OSP’s findings of alleged corrupt activities involving Labianca Group of Companies and the Customs Division.

The said report concluded that the owner of the company, Eunice Jacqueline Buah Asomah- Hinneh had taken advantage of her position as a Board member of the Ghana Ports and Habours Authority (GPHA) at the time to get favours.
